By accessing or using SnugStories ("the Service"), operated by Cooper Studios, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SnugStories is an AI-powered platform that generates personalized bedtime stories and illustrations for children. The Service includes story generation, cover art creation, story saving and sharing, audio narration, and related features. We also offer physical products through third-party print-on-demand providers.

3. AI-Generated Content

Stories and images generated by SnugStories are created using artificial intelligence. Under current United States copyright law, AI-generated content may not be eligible for copyright protection. By using our Service, you acknowledge and agree that:

Generated stories and artwork are provided for personal and family use.
AI-generated content may not be copyrightable under current law, and we make no representations regarding copyright ownership of generated content.
You may save, download, print, and share stories generated for your personal use.
You may not resell, redistribute, or commercially exploit AI-generated stories or artwork as standalone products without our written permission.
We are not responsible for any similarities between AI-generated content and existing copyrighted works.

4. Content Safety

We employ multiple safeguards to ensure AI-generated content is appropriate for children, including safety prompts, content filtering, and input sanitization. However, AI systems are not perfect. We cannot guarantee that all generated content will be free from errors, inappropriate material, or unintended outputs. If you encounter inappropriate content, please report it immediately to hello@snugstories.com.

5. User Accounts

You may create an account using Google authentication or other supported login methods. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 13 years of age to create an account.

6. Children's Privacy (COPPA)

SnugStories is designed for use by parents and guardians on behalf of their children. We do not knowingly collect personal information directly from children under the age of 13. Character details provided by parents are used solely for real-time story generation and are not stored permanently. For full details, see our Privacy Policy.

7. Acceptable Use

You agree not to:

Use the Service to generate content that is harmful, abusive, threatening, or inappropriate for children.
Attempt to circumvent rate limits, security measures, or access controls.
Use automated scripts, bots, or scrapers to access the Service.
Impersonate another person or misrepresent your identity.
Use the Service for any illegal purpose.

8. Subscriptions and Payments

We offer a free tier and a premium subscription tier. Premium subscriptions are billed monthly or annually through our payment processor (Stripe). You may cancel your subscription at any time. Refunds are handled on a case-by-case basis. Pricing is subject to change with reasonable notice.

9. Physical Products

Physical products (books, blankets, apparel, etc.) are fulfilled by third-party print-on-demand providers. We are not responsible for manufacturing defects, shipping delays, or issues caused by third-party providers. Product returns and refunds are subject to the policies of the respective fulfillment provider.

10. Intellectual Property

The SnugStories name, logo, website design, source code, and all human-created content are the intellectual property of Cooper Studios, LLC and are protected by copyright and trademark law. The compilation, arrangement, and curation of AI-generated content within our platform is also protected.

11. Data Retention

Free users' saved stories may be retained for up to 30 days with no guarantee of availability. Premium subscribers' stories are retained for the duration of their active subscription. We reserve the right to delete any content at any time. We recommend downloading PDF copies of any stories you wish to keep permanently.

12. Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied. Cooper Studios, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Cooper Studios, LLC from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
